GlucaChill operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). GlucaChill is powered by Shopify, which enables us to provide the Services to you.


Please read these Terms and Conditions ("Terms") carefully before using glucachill.com (the "Site"). These Terms govern your access to and use of the Site, including any purchases you make and your participation in the GlucaChill Membership Program.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

Prices are subject to change without notice. We are not responsible for typographical errors in pricing. In the event of a pricing error, we reserve the right to cancel affected orders and notify you accordingly.

8. GlucaChill Membership Program

8.1 Overview

GlucaChill offers an optional membership program (the "Membership") that provides enrolled members with exclusive benefits. Enrollment in the Membership is entirely voluntary. The GlucaChill Membership is not a negative-option program. Members receive immediate access to all benefits upon enrollment and may cancel at any time.


These Membership Terms supplement the general Terms and Conditions, Privacy Policy, Shipping Policy, and Refund Policy.

8.2 Basic Representations

By enrolling in the Membership, you represent that:


  • You are at least 18 years of age

  • You have read and agree to these Terms and Conditions and our Privacy Policy

  • You are voluntarily opting in to a recurring membership and understand the associated fees and benefits

8.3 Membership Benefits

Active members receive the following benefits while their Membership is active:


  • Exclusive member-only discounts on GlucaChill products

  • Free shipping on all orders placed through the Site

  • Priority order processing

  • Access to member-only promotions and offers


Benefits are available immediately upon enrollment and remain available throughout each paid membership term.

8.4 Membership Fee

The Membership fee is $19.95 USD per 30-day membership term (exclusive of applicable taxes). Your payment method will be charged this amount upon enrollment for the initial term.

8.5 Renewal

At the end of each 30-day membership term, your Membership will automatically renew for an additional 30-day term at the then-current membership fee unless you cancel prior to the end of the current term. Renewal is provided for your convenience to ensure uninterrupted access to your member benefits.


You will be notified of your upcoming renewal via email at least seven (7) days before the renewal date. You will never be charged more than the stated membership fee without your express consent.

8.6 Billing Descriptor

GlucaChill Membership charges will appear on your payment statement as GLUCACHILL.COM.

8.7 Cancellation

You may cancel your Membership at any time, for any reason. Cancellation will take effect at the end of your current 30-day paid term — you will retain access to all membership benefits through the end of the paid period.

Cancellation requests must be received at least three (3) business days before the end of your current membership term to avoid renewal charges for the following term.

8.8 Membership Refund Policy

Membership fees are non-refundable once a membership term has begun, including for partially used terms. If you believe you have been charged in error, please contact us at info@glucachill.com or 1-888-293-5290 and we will review your account.

8.9 Modification or Termination of the Membership Program

We reserve the right to modify, suspend, or discontinue the Membership Program at any time. If we discontinue the Program, we will provide reasonable notice and will not bill you for any future terms beyond the current paid period.


We may terminate your Membership immediately, without notice, if you violate any provision of these Terms or engage in fraudulent or abusive conduct. You will remain responsible for any outstanding amounts due as of the termination date.

8.10 Account Information

To access certain Membership benefits, you may need to log in to your GlucaChill account using credentials provided at sign-up. You are responsible for maintaining the confidentiality of your account credentials. Please contact us at info@glucachill.com if you experience any login issues.

 

9. Email and SMS Marketing

9.1 Email Communications

By providing your email address and consenting at checkout or sign-up, you agree to receive marketing emails from GlucaChill, including promotional offers, product announcements, and newsletters. You may opt out at any time by clicking "Unsubscribe" in any marketing email or by contacting info@glucachill.com.

Consent to receive marketing emails is not a condition of purchase.

9.2 SMS / Text Message Communications

By providing your mobile phone number and opting in through our checkout or sign-up form, you consent to receive recurring automated marketing text messages from GlucaChill (operated by Cosmic Media Labs LLC) at the mobile number you provided, including promotions, product updates, and offers.


  • Message frequency varies based on your activity and promotions.

  • Message and data rates may apply depending on your mobile carrier and plan.

  • To opt out: Reply STOP to any text message at any time. You will receive a confirmation message and will not receive further marketing texts.

10. Disclaimer of Warranties

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.


Because some jurisdictions do not allow the exclusion or limitation of certain damages, the above limitations may not apply to you in full.

 

12. Indemnification

You agree to indemnify, defend, and hold harmless Cosmic Media Labs LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts located in Delaware.
